These Terms and Conditions (“Terms”) govern the use of the PropLyst platform, operated by Vivetha Business Consultancy LLP (“Company,” “we,” “our,” or “us”), under the trade name PropLyst. These Terms apply to all individuals (“User,” “you,” or “your”) who access, browse, or otherwise use the Platform and/or the mobile application.

These Terms have been formulated in accordance with applicable laws in India, including but not limited to the Information Technology Act, 2000, and relevant rules and regulations.

By accessing, browsing, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any provision, you must discontinue use of the Platform immediately.

PropLyst functions solely as an online platform facilitating user interaction, including property listing, search, and related service discovery.

The Platform acts solely as a neutral venue for users to list and view properties and related services. PropLyst makes no representations or warranties, express or implied, regarding the accuracy, completeness, truthfulness, legality, or reliability of any property listing, user information, or third-party services displayed on the Platform.

Users bear sole responsibility for verifying the accuracy, authenticity, and legal standing of any property listing, user information, or third-party services they engage with. PropLyst does not independently verify ownership, legal documentation, or transaction feasibility.

PropLyst does not endorse, recommend, guarantee, or certify any user, property owner, tenant, broker, or third-party service provider. Any reliance on information obtained through the Platform is strictly at the user’s sole risk.

All agreements, payments, legal formalities, and transaction-related steps must be handled independently by the involved parties. PropLyst disclaims liability for the outcome of any such interaction or transaction.

PropLyst has no duty to independently verify the identity, financial standing, or legitimacy of any user or property. Any optional verification service is provided only for convenience and does not constitute a guarantee.

PropLyst disclaims liability for fraudulent activity, misrepresentation, or misinformation provided by users. If fraudulent, misleading, or illegal activity is detected, PropLyst may suspend or terminate the account and may report the matter to appropriate authorities.

PropLyst is not responsible for any loss, damages, disputes, or financial transactions between users. All dealings are carried out at the user’s own discretion and risk.

Users agree to indemnify and hold PropLyst, its directors, employees, and affiliates harmless against claims, disputes, liabilities, or losses arising from their use of the Platform, including property disputes, fraudulent transactions, breach of contractual obligations, and statutory claims.

Users are required to comply with all applicable real estate laws and regulations, including the Real Estate (Regulation and Development) Act, 2016 (RERA), the Consumer Protection Act, 2019, and local municipal and state property laws.

PropLyst reserves the right to remove listings or suspend accounts that violate applicable laws or regulations.

Users must create an account to access full services and are required to provide accurate details such as name, email address, and phone number.

OTP authentication may be required to verify identity and enhance security. Users are responsible for safeguarding their login credentials and reporting unauthorized access immediately.

Biometric authentication may be available on supported devices. Third-party sign-in methods such as Google or Apple may also be permitted, subject to their own privacy policies.

PropLyst reserves the right to suspend or terminate accounts that contain false, incomplete, or misleading information.

Users may request account deletion by contacting support@propertytrades.com, subject to legal retention requirements.

The User agrees to provide truthful, complete, and accurate information. If submitted information is found to be inconsistent, inaccurate, or incomplete, PropLyst may suspend or terminate access without liability.

Users are solely responsible for any comments, ideas, suggestions, photos, videos, graphics, or other content they post through the Platform.

Users must not post content that is defamatory, fraudulent, offensive, obscene, threatening, privacy-violating, infringing, or harmful in any way, including malware or malicious code.

When User Content is shared with PropLyst, the User grants the Company a worldwide, royalty-free, transferable, perpetual, non-exclusive, and sublicensable license to use, reproduce, distribute, modify, display, and create derivative works from that content for Platform-related purposes.

The User affirms that they are legally competent and eligible to enter into binding agreements under the Indian Contract Act, 1872.

The User must be at least 18 years of age to register and use the Platform. If registering on behalf of an entity, the User must have authority to bind that entity.

Users previously banned, suspended, or restricted by PropLyst are prohibited from creating new accounts unless reinstated.

PropLyst provides Services subject to these Terms and the Privacy Policy. Together, they form a binding agreement between the User and PropLyst.

Each time the User accesses the Site or completes registration, the User agrees to be bound by the Agreement.

Individuals below 18 years of age may access the Platform only through a parent or legal guardian’s account and under their supervision.

The User is responsible for all activities conducted through their account and must ensure the confidentiality of account details and passwords.

PropLyst may suspend or terminate an account after receiving notice of unauthorized access or misuse, but will not be liable for losses arising from a security breach.

Users are strongly advised to use secure passwords, enable device-level security, and periodically update credentials.

PropLyst reserves the right to terminate or suspend access where fraudulent, abusive, illegal, harmful, or policy-violating activity is suspected.

Termination may also occur where inaccurate or misleading information is provided, where inactivity is prolonged, or where a user’s conduct damages the Platform, brand, or user experience.

PropLyst may deactivate or delete an account and restrict further access without prior notice where permitted under these Terms.

Browsing the Platform is free, but charges may apply for certain services offered through PropLyst.

PropLyst reserves the right to introduce or revise charges for any service, with notice to users where applicable.

For listings, tokens, or service facilitation, PropLyst may act only as a facilitator, including coordination with escrow arrangements or payment gateway service providers.

Refunds, cancellations, and disputes relating to tokens or service-related payments may be subject to the terms of the developer or service provider involved.

The Platform may support payment methods including debit cards, credit cards, third-party wallets, net banking, and other payment systems approved by the Reserve Bank of India.

PropLyst acts only as a facilitator of payment infrastructure and does not provide banking or financial services.

Transaction information is encrypted, and card data is handled by authorized banking or card-processing infrastructure rather than being stored directly by PropLyst.

PropLyst is not liable for unauthorized transactions, payment failures, chargebacks, or processor-related issues beyond the extent permitted by law and these Terms.

PropLyst may offer paid subscription-based services depending on the user’s needs.

Unless otherwise stated, subscription fees are generally non-refundable, except where a specific money-back plan is explicitly offered.

PropLyst may revise subscription fees and pricing structures from time to time.

PropLyst may acquire, retain, use, and disclose User Information in accordance with applicable law and the Platform’s Privacy Policy.

User Information may be used for service delivery, account registration, alerts, research, internal studies, communication, service improvement, property updates, and legally compliant disclosures.

Users may also receive promotional or marketing communications directly from PropLyst or through authorized partners, subject to applicable law and available opt-out mechanisms.

Users acknowledge and consent to the use of cookies, tracking pixels, and similar technologies for analytics, personalization, and advertising purposes.

Third-party service providers may deliver targeted advertisements and generate reports on engagement, impressions, and related metrics.

Users accessing services through the mobile application may receive in-app advertisements and should review device-level operating system settings to manage ad preferences.

PropLyst may engage third-party service providers to support or enhance the provision of services to users.

These services may include logistics, relocation assistance, furnishing support, registration assistance, neighborhood insights, documentation help, and other ancillary services.

PropLyst and third-party providers operate on a principal-to-principal basis, and PropLyst is not liable for the acts, omissions, services, products, or disputes arising from such third-party interactions.

Any dispute arising out of or in connection with these Terms shall be resolved through a two-step alternate dispute resolution mechanism: mediation followed by arbitration if mediation fails.

If unresolved within 30 days, the dispute shall be referred to binding arbitration before a sole arbitrator appointed by PropLyst.

The arbitration shall be conducted in English, and the seat and venue of arbitration shall be Hyderabad, Telangana, India.

These Terms shall be governed by the laws of India, and the courts in Hyderabad, Telangana shall have exclusive jurisdiction, subject to PropLyst’ reserved rights where applicable.

The User agrees to release, defend, indemnify, and hold harmless PropLyst and its affiliates, officers, employees, and representatives from claims, damages, losses, liabilities, and expenses arising from the User’s actions, omissions, breach of Terms, misrepresentation, or unlawful conduct.

PropLyst provides the Platform on an “as is” and “as available” basis without warranties of any kind.

To the fullest extent permitted by law, PropLyst shall not be liable for special, incidental, indirect, consequential, exemplary, or punitive damages, including loss of profits, data, business, goodwill, or service interruption.

Where liability cannot be excluded, the aggregate liability of PropLyst shall be limited to the fees paid by the User for the specific service giving rise to the claim.

All trademarks, service marks, logos, domain names, designs, software, graphics, materials, brand identifiers, and proprietary platform elements remain the exclusive property of PropLyst unless expressly stated otherwise.

Users may not copy, modify, distribute, reproduce, sell, license, or exploit any part of the Platform or its intellectual property without prior written consent.

PropLyst may take legal action in response to infringement, misuse, or unauthorized reproduction of its intellectual property.

Where PropLyst facilitates rental agreement services, it acts solely as a facilitator and does not guarantee legal validity, enforceability, or compliance of the agreement with applicable law.

The tenant and landlord must provide accurate and complete information.

PropLyst is not liable for disputes, fraud, financial losses, security deposit issues, unpaid rent, damages, legal conflicts, or statutory dues arising from the rental relationship.

Users must not copy, distribute, modify, reverse engineer, scrape, decompile, or create derivative works from Platform content or software without express written permission.

Users must use the App and Platform only for lawful purposes and in compliance with all applicable laws.

Users must not attempt to bypass security, gain unauthorized access, or misuse the Platform, including through bots, spiders, or automated scraping mechanisms.

PropLyst reserves the right to remove objectionable content and terminate repeat violators.

Users must not engage in harassment, impersonation, false representation, unlawful publication, intellectual property infringement, malware distribution, platform disruption, unlawful data collection, spam, misleading content, or any conduct that threatens national security, public order, or legal compliance.

PropLyst reserves the right, but not the obligation, to monitor, edit, remove content, and suspend accounts for violations.

Users remain solely responsible for the content they post and the consequences arising from it.

The Platform may contain links to third-party sites, services, or resources. PropLyst does not control, endorse, or assume responsibility for such third-party platforms.

Any interaction, transaction, or reliance involving third-party websites, finance partners, social logins, or service providers is solely at the user’s own risk.

PropLyst may change, update, or modify these Terms at any time, and continued use of the Platform shall be deemed acceptance of such changes.

These Terms, together with the Privacy Policy, constitute the entire agreement between the User and PropLyst.

If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Users may report grievances, policy violations, or objectionable content to support@propertytrades.com.

The information on the Platform is intended only as general guidance and should not be treated as legal, financial, or real estate advice.

Users must perform their own independent inquiries and seek professional advice before making decisions.

PropLyst does not guarantee uninterrupted service, error-free operation, listing accuracy, third-party service quality, or user authenticity.

The Platform and all services are offered on an “as is” basis without express or implied warranties unless expressly stated otherwise.

Vouchers and gifts offered by PropLyst are promotional in nature and are subject to specific terms and conditions.

They are generally non-refundable, non-exchangeable for cash, non-transferable, and may be valid only in connection with property purchases or specific promotions.

PropLyst is not responsible for lost, stolen, tampered, damaged, or destroyed vouchers or gifts.

Users may report complaints, fraud concerns, grievances, or law-enforcement-related requests to support@propertytrades.com.
